Privacy Notice

1. Who we are

BareHacks Software Solutions OPC ("Barehacks", "we", "us") is a corporation registered with the Securities and Exchange Commission (Company Reg. No. 2026080265513-13), with its principal office in Buhangin, Davao City 8000, Philippines. We design and build websites, web apps and mobile apps.

For the personal information described in this notice, we are the personal information controller under the Data Privacy Act of 2012 and its Implementing Rules and Regulations.

2. What we collect

Information you give us

• Project inquiry form: your name, email address, company name (optional), the services you are interested in, your budget range, and your message.
• Emails, calls and messages: anything you send us directly by email, phone or Viber, including your contact details and the content of your message.

Information collected automatically

• Technical data: your IP address, browser type, device type and the pages you request. Our hosting provider processes this to deliver the site and protect it from attacks.
• Aggregate analytics: page views and referrers, counted without cookies and without identifying you (see section10).

We do not ask for sensitive personal information, such as government ID numbers, health information or financial account details. Please do not include it in your messages.

3. How we use it

• To reply to your inquiry, ask follow-up questions, and prepare a scope, timeline or quotation.
• To communicate with you about a project, if you become a client.
• To keep the website secure and to filter spam and abuse sent through our forms.
• To understand, in aggregate, which pages are visited so we can improve the site.
• To meet our legal obligations, including tax and corporate record-keeping for clients.

We do not sell your personal information, and we do not add you to marketing lists unless you ask us to.

4. Legal basis

Under Section 12 of the Data Privacy Act, we process your information on these grounds:

• Consent, which you give when you submit our inquiry form or contact us.
• Steps taken at your request before entering into a contract, such as preparing a proposal.
• Compliance with a legal obligation, such as keeping records required by Philippine tax law.
• Our legitimate interests in keeping the website secure and free of abuse, where these are not overridden by your rights.

You may withdraw your consent at any time by contacting us (section 13). This does not affect processing already done.

5. Who we share it with

We share personal information only with service providers that help us run the website and reply to you. They process it on our instructions and under their own security and privacy commitments:

• Cloudflare, Inc. hosts the website, protects it from attacks, checks that inquiry form submissions come from people rather than bots (Cloudflare Turnstile), and provides cookie-free analytics.
• Resend delivers the messages you send through our inquiry form to our inbox.
• Google Workspace (Google LLC) hosts our business email.

We may also disclose information when required by law, court order or a lawful request from a government authority, or to protect our rights in a legal claim.

6. Transfers outside the Philippines

Our service providers may store or process information on servers outside the Philippines, including in the United States. We remain accountable for your information wherever it is processed, and we use providers that apply security measures comparable to those required by the Data Privacy Act.

7. How long we keep it

• Inquiries that do not become projects: deleted within two (2) years of our last contact with you.
• Client records: kept for the duration of the engagement and afterwards for the period required by Philippine tax and corporate laws.
• Technical logs: kept by our hosting provider for short periods for security purposes.

When information is no longer needed, we delete it or make it anonymous.

8. Security

The website is served only over encrypted HTTPS. Access to inquiries and client information is limited to the people who need it to do their work, and we use accounts protected by strong passwords and two-factor authentication. No method of transmission or storage is completely secure, but we work to protect your information against loss, misuse and unauthorized access.

If a personal data breach occurs that is likely to put you at risk, we will notify you and the National Privacy Commission as the law requires.

9. Your rights

Under the Data Privacy Act, you have the right to:

• Be informed about how your personal information is processed.
• Access the personal information we hold about you.
• Object to processing, including processing based on consent.
• Correct information that is inaccurate or incomplete.
• Erase or block information that is unlawfully obtained, no longer necessary, or processed against your rights.
• Data portability: get a copy of your information in an electronic format you can use elsewhere.
• Claim damages for harm caused by inaccurate, false or unlawfully obtained information.
• File a complaint with the National Privacy Commission at privacy.gov.ph.

To exercise any of these rights, contact our Data Protection Officer (section 13). We may ask you to confirm your identity before acting on your request.

10. Cookies and analytics

This website does not use advertising or tracking cookies. We measure traffic with Cloudflare Web Analytics, which counts page views without cookies and without building a profile of you.

Our hosting provider may set strictly necessary security cookies to tell people apart from automated bots. These cookies do not track you across other websites.

11. Children

This website is meant for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has sent us their information, contact us and we will delete it.

12. Changes to this notice

We may update this notice when our practices or the law change. The date at the top shows when it was last updated. Significant changes will be highlighted on this page.
